I would guess that it would be forced to be taken down immediately, and then litigation would determine whether it can be put back up.

Unlike Ryujinx they should try to have redundancies in case of Team members leaving and be willing to boot and ostracize members who attempt to sabotage the project. The other piece would be to either develop from regions where Nintendo has no legal leverage, or try to stay safe with cleanroom and PR techniques (losing battle since the USA is crooked when it comes to IP and freedom).

Sort of. Nintendo's lawyers showed up at the house of the lead dev and he nuked everything he had access to afterwards, which is all we really know, but unlike Yuzu there were no court filings or takedowns or anything. Forks of Ryujinx are still just up on Github.

The actual answer to that question is that the Switch 2 will be out soon. Nintendo doesn't actually want to go to court over emulators, because there's a real chance they lose. They were willing to push the devs with Switch emulators though, because that's the current console generation, and that REALLY pissed them off. They've basically accepted that emulators are inevitable even if they don't like it, but emulating the console they are currently releasing new games for was a step too far as far as they're concerned.

Fair, but also the Switch 2 has some backwards compatibility to Switch games. So they may still have an interest despite Switch 2 being out to prevent games that could still be sold on Switch 2 to be emulated via this.

Can't wait for the Switch 2 emulator so I don't have to support nintendo's bad decisions but still play games day 1.
